- Capital Markets Your Function:
North America Compliance (NAC) is responsible for US regulatory compliance and anti-money laundering controls for Rabobank’s activities in North America aligned with Rabobank Group Standards and applicable EU regulation. The prime regulators are the DNB in the Netherlands where Rabobank is headquartered, the Federal Reserve Bank of New York, the Board of Governors of the Federal Reserve System, the New York State Department of Financial Services, the CFTC, the OCC, SEC and FINRA in the U.S. and the local regulatory authorities in Canada (OSFI) and Mexico (SHCP, CNBU and Banco de Mexico).
The operations Rabobank engages primarily in within the US is Wholesale Banking activities (New York Branch), Retail (Rabobank, N.A.), Rural (Rabo Agri Finance) and Leasing (De Lage Landen). Further legal entities include the New York and Canadian branches, Mexico Rep Office, Rabo Securities USA, Inc., the broker-dealer, Utrecht-America Holdings, Inc., the bank holding company, and other U.S. entities.
Responsible for establishing, maintaining and overseeing all aspects of the U.S. wide Bank Secrecy Act (BSA), Anti-Money Laundering (AML) and Sanctions (OFAC) programs:
(A) Coordinating and assisting in the administration of independent, state and federal regulator and auditor examinations and reviews
(B) Coordinating responses to regulatory BSA/AML examinations and audits and actions taken to insure deficiencies are corrected
(C) Maintains proficient knowledge of the rules and regulations, including but not limited to, the Bank Secrecy Act (BSA) , USA Patriot Act, and OFAC
(D) Responsible for defining and managing the Program including risk assessment methodology, governance / processes, analysis and action plan(s).
(E) Promoting the Program, including ownership of obligations, establishing and maintaining a compliance framework, serving as a consultant on projects, evaluating compliance requirements, providing compliance training.
(F) Presentation and explanation of the Program and output to executive management.
(G) Coordinate and maintain an effective governance and oversight of the US Operations.
(H) Recommending updates to the Program to address material developments and changes in laws, regulations and guidance.
(I) Overseeing the development of and updates to the various BSA/AML/Sanctions risk assessment(s); supporting the development of short and long term program initiatives responsive to the risk assessment(s).
(J) Development and maintenance (ownership) of policies and procedures to enable the effective identification and management of risks.
(K) Enhancement of management information and reporting to enable effective oversight of the applicable committees in both the US and the Netherlands; reporting information on trends, regulatory developments and specific BSA/AML/Sanctions matters.
(L) Escalating risk matters to executive management when not sufficiently resolved.
(M) Tracking and recording resolution of all issues related to the BSA/AML Program identified through independent reviews of the Program or regulatory examinations to the RCCO and executive management.
(N) Communicating BSA/AML compliance issues, regulatory issues and other BSA/AML developments to the RCCO and executive management.
(O) Overseeing all regulatory examinations and internal audits including addressing all findings and recommendations in a timely manner.
(P) Monitoring legal and regulatory developments and best practices with respect to BSA/AML laws and regulations and reporting such developments to the RCCO and executive management.
(Q) Oversight of the US Operations entity level BSA/AML programs.
(R) Functional management of US Operations entity level BSA/AML officers.
(S) Analyzing requirements from Head Office for applicability in the US.
(T) Participation in industry-related organizations to keep abreast of regulatory issues and general consensus to these. Your Profile:
Qualifications:(Essential):
(1) 12+ years of working within the financial services industry
(2) Extensive knowledge of BSA/AML and Sanctions regulation and expectations
(3) Bachelor’s degree (or equivalent)
(Desirable):
(1) Post-graduate degree (JD or MBA)
(2) CAMS qualification (or equivalent)
Job Skills and Knowledge:
(1) Strong knowledge of developing and implementing AML/BSA and Sanctions Programs in a top financial institution.
(2) Experience of successfully embedding policies and procedures into a multi-national organization
(3) Experience of and working with financial institutions
(4) Able to demonstrate a practical and commercial approach to Compliance.
(5) Ability to offer strategic advice with common sense day-to-day responsibilities.
